When a work-related accident leads to permanent disability

Workplace safety is a primary concern for many New York employers. However, as the saying goes, accidents happen. Despite all attempts to follow safety guidelines, employees still get injured on the job. Although most injured workers eventually recover from their injuries, some are so severely injured that they are disabled for the rest of the their lives. This can be a physically and financially difficult situation, and, to add to it, insurance companies do whatever they can to deny the claim, leaving the victim in a tough place.

Not only is a disabled person unable to work, but he or she is also unable to earn income to pay for expensive medical care. This is a heavy burden to bear, but fortunately, there are legal remedies available to help those who are permanently disabled receive the compensation they need to comfortably live the rest of their lives.

There are three types of compensations available. In this situation, probably the easiest one to receive would be workers’ compensation. This is given to victims of workplace accidents, regardless of fault. There is also Social Security Disability Insurance, which is given to those who can prove that their disability will render them unable to work for at least one year. If the disability was caused by someone else’s negligence, then the victim can file a personal injury lawsuit and recover damages that way as well.

If you suffered a work-related accident that resulted in serious injuries or disability, you have the right to receive compensation. However, proving the claim is the tough part, which is why it is important to have an experienced workers’ compensation attorney on your side to guide you through the process.
