Falling concrete leads to fatal construction accident


New York construction workers put themselves in danger almost every day. Construction sites are full of hazards - such as machinery, power tools, heavy materials and heights - all of which can cause serious injuries or even death. As an unfortunate example, a construction worker recently died after he was struck by falling concrete.

The 46-year-old man was working on a construction site on the afternoon of May 23 when a concrete wall suddenly fell on him. Police were called to the scene of the construction accident and the man was taken to a local hospital for medical treatment. Unfortunately, the man died several hours later.

There are no details as to what exactly caused the wall to fall. However, negligence could be attributed to the worker or the employer, or both. If the employer failed to provide proper training or safety equipment, then it can be held liable. Typically, the Occupational Health and Safety Administration will perform an investigation after a workplace death. The results of the OSHA investigation will determine the exact cause of death, as well as the liable party. This investigation can take up to six months to finalize.

If the employer is liable, the family of the victim could potentially file a wrongful death lawsuit. This lawsuit can help the family recover compensation for the damages they suffered. Damages can be emotional or economic in nature, and can include medical bills, funeral expenses, lost wages, mental anguish and emotional distress. If the man in this recent case had a family who depended on him financially, the family could claim loss of support as well.
